These Terms of Service ("Terms") govern your use of the Truscott mobile app, website, and related services (the "Services") provided by Truscott Inc., doing business as Truscott Insurance Solutions and Truscott Insurance ("Truscott," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Description of Services

Truscott Inc. (d/b/a Truscott Insurance Solutions and Truscott Insurance) is a licensed independent insurance agency and producer. We solicit, quote, and help you place coverage through appointed, licensed agents and the insurance carriers we represent, and we may help bind coverage on your behalf when you authorize us to do so. Truscott does not underwrite, issue, or guarantee any insurance policy. All policies are issued solely by the applicable insurance carrier, subject to the carrier's terms, conditions, and underwriting approval. Insurance products are offered only in states where Truscott and the assigned producer are licensed and appointed.

The Services include tools for uploading and analyzing insurance documents, requesting quotes, comparing coverage options, receiving renewal reminders, and communicating with licensed agents. Some features use artificial intelligence and automated processing to assist you with policy analysis, claims guidance, and document review.

2. Eligibility and Account Registration

You must be at least 18 years old to use the Services. By creating an account, you represent that the information you provide is accurate and complete, and you agree to keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Each person may maintain only one account. We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

3. Insurance Quotes and Binding

Quotes provided through the Services are estimates based on the information you supply and are not guarantees of coverage or final premium. Actual premiums, terms, and coverage are determined by the insurance carrier through its own underwriting process.

Requesting a quote does not create an insurance policy. A policy is only effective when a carrier has approved and issued it. By selecting a quote and authorizing binding, you consent to share your information with the applicable carrier and agent to complete the transaction.

You should review all policy documents carefully before and after purchase. Truscott is not responsible for the terms, conditions, exclusions, or limitations of any insurance policy issued by a carrier.

4. AI-Powered Features and Automated Tools

The Services include features that use artificial intelligence and automated tools to analyze documents, summarize coverage, identify potential gaps, and provide general guidance. These outputs are provided for informational purposes only and are not a substitute for professional insurance advice.

AI-generated content may be incomplete, inaccurate, or outdated. You should not rely solely on automated outputs when making coverage, claims, or financial decisions. Always review original policy documents and consult with a licensed insurance professional for definitive guidance.

Truscott may operate or be affiliated with educational blog websites that publish insurance-related content. Content on these sites, including content generated with the assistance of artificial intelligence, is provided for general informational purposes only and does not constitute insurance advice. If you submit your contact information through a lead form on one of these sites, your information will be handled in accordance with our Privacy Policy.

5. Data Sharing with Carriers and Agents

When you request quotes or authorize policy binding, we share your personal information with licensed insurance agents and carriers involved in fulfilling your request. You can manage your data-sharing preferences in your account settings.

6. User Conduct

You agree not to:

  • provide false, misleading, or incomplete information;
  • use the Services for any unlawful purpose or in violation of any applicable laws or regulations;
  • attempt to gain unauthorized access to any part of the Services or any systems or networks connected to the Services;
  • interfere with or disrupt the operation of the Services;
  • use automated means to access the Services without our written permission; or
  • upload malicious software, viruses, or harmful content.

7. Intellectual Property

The Services, including all content, features, design, software, and trademarks, are owned by or licensed to Truscott and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Services without our express written permission.

You retain ownership of any documents or information you upload to the Services, and grant us a limited license to process and store that content solely to provide the Services to you.

If you submit feedback, suggestions, bug reports, screenshots, or other input through the Services, you grant Truscott a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, and incorporate that feedback for any purpose, including improving the Services. You acknowledge that feedback submissions are voluntary and that Truscott is under no obligation to compensate you or to keep feedback confidential.

8. Limitation of Liability

To the fullest extent permitted by law, Truscott and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or coverage, arising from your use of the Services.

Truscott is not liable for the actions, decisions, or omissions of any insurance carrier, agent, or third-party service provider. We do not guarantee the availability, accuracy, or suitability of any insurance product or quote. Our total aggregate liability for any claim arising from these Terms or the Services shall not exceed the amount you paid to Truscott, if any, in the twelve months preceding the claim.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Indemnification

You agree to indemnify and hold harmless Truscott and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Account Termination

You may close your account at any time through your account settings or by contacting us. Upon deletion, we will remove your personal information as described in our Privacy Policy.

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. Provisions that by their nature should survive termination will survive, including sections on intellectual property, limitation of liability, indemnification, and dispute resolution.

12. Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration administered in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms, to the extent permitted by law. We encourage you to review these Terms periodically.
